Appeals Policy for Depicted Persons

1. Who Can File an Appeal
If you are depicted in content on SexySelfies and wish to have it removed, you have special appeal rights under our policy. This applies to you if:
- You appear in photos or videos uploaded to our platform
- You did not consent to the content being uploaded
- Your consent was obtained under false pretenses or coercion
- You were under 18 when the content was created
- You have revoked previously given consent
- Your consent is void under applicable law
Important: You do not need to be the person who uploaded the content to request its removal. If you are depicted in the content, you have the right to request removal.
2. How to File a Content Removal Appeal
To request content removal as a depicted person, please follow these steps:
Step 1: Gather Required Information
- The URL(s) of the content featuring you
- A government-issued photo ID showing your face and date of birth
- A recent photo of yourself holding your ID and a note with today's date
- A brief explanation of why you're requesting removal
Step 2: Submit Your Appeal
You can submit your appeal through any of these methods:
- Email: Send all required documents to appeals@sexyselfies.com
- CCBill Form: Submit via CCBill Complaint Form
- Report Button: Click the three-dot menu on the content page and select "Report"
Privacy Notice: Your identity verification documents will be used solely to verify your identity and will be deleted within 30 days after your appeal is resolved.
3. Identity Verification Process
To protect both you and content creators from fraudulent removal requests, we must verify your identity before removing content.
What We Verify:
- Identity Match: We compare your submitted photo ID to the person depicted in the content to confirm you are the same person.
- Photo Authenticity: We verify that your ID and selfie are legitimate and not manipulated.
- Age Verification: We confirm your date of birth to ensure you were 18+ when the content was created.
Verification Timeline:
- Immediate Action: If we have reasonable suspicion that you were a minor in the content, we will immediately remove the content pending investigation.
- Standard Review: Most identity verifications are completed within 24-48 hours.
- Final Decision: We will notify you of our decision within 5 business days.
4. Consent Validation
After verifying your identity, we will evaluate whether valid consent existed for the content upload.
Content Will Be Removed If:
- You did not consent to the upload
- Your consent was obtained through coercion, fraud, or deception
- You were under 18 when the content was created
- You have legally revoked your consent
- The content violates applicable laws (revenge porn, non-consensual intimate images, etc.)
Content May Not Be Removed If:
- You provided documented, verifiable consent to the creator
- The content was uploaded as part of a valid commercial agreement you signed
- You are attempting to remove content after a business dispute
Note: Even if a formal agreement existed, consent obtained through fraud, coercion, or when you were a minor is void and the content will be removed.
5. Possible Outcomes
After reviewing your appeal, one of the following actions will be taken:
Immediate Content Removal:
- Content depicting minors (anyone under 18)
- Non-consensual intimate images
- Revenge porn
- Content where consent was clearly void
Creator Account Actions:
If consent was not given or was void, we may also take action against the creator:
- Warning: First-time violations with mitigating circumstances
- Account Suspension: Repeated violations or serious consent issues
- Permanent Ban: Uploading content of minors or patterns of non-consensual content
- Law Enforcement Referral: Illegal content (especially minors) will be reported to NCMEC and law enforcement
Appeal Denied:
If we determine valid consent existed and the content does not violate our policies, your appeal may be denied. You will receive a detailed explanation of our decision.
6. Neutral Third-Party Resolution
If you disagree with our decision on your appeal, you may request resolution by a neutral third-party arbiter.
How It Works:
- Email appeals@sexyselfies.com within 30 days of our decision
- State that you wish to escalate to neutral arbitration
- We will coordinate with one of our approved arbitration services:
- American Arbitration Association (AAA)
- JAMS
- The arbiter will review all evidence and make a final, binding decision
Arbitration Costs:
- Costs are split equally between you and SexySelfies
- Typical cost: $250-500 per party (may vary)
- The arbiter's decision is final and binding on both parties
Legal Action: If you believe the content violates criminal law (revenge porn, child exploitation, etc.), you may also file a police report and we will cooperate fully with law enforcement.
7. Special Protections for Minors
Content depicting anyone under 18 is strictly prohibited and will be removed immediately upon detection.
If You Were a Minor:
- We will remove the content within 24 hours of verification
- We will permanently ban the uploader
- We will report the content to the National Center for Missing & Exploited Children (NCMEC)
- We will cooperate fully with law enforcement investigations
- You do not need parental consent to file this appeal
